How it works
Can I submit my report or question anonymously?
Yes.
To remain anonymous, make sure that you do not provide information that will directly or indirectly disclose your identity when filling out forms and when attaching documents.
Check whether your internet connection is safe and the browser you are using, displays a padlock icon. To submit your report use a private device only that is not connected to the organization's network. Furthermore, you should only access your inbox in the application on a private device and in a secure private network environment.
How do I anonymise my report?
Does the document contain direct information about the person, such as name, place or mail address? These details should be deleted or blacked out.
Does the information in the document allow identification of the person because only this person has knowledge of the reported event? Coordinate the procedure with the ombudsperson by telephone beforehand.
Do the properties of the electronic document (Word, Excel, PDF, etc.), which can be found via the corresponding tab, contain information about the issuer or processor of the document or the storage location? If you want to protect your identity, make sure that all data containing such information are deleted from the Properties section. Information on the storage location cannot be changed; you must therefore select a storage location with a neutral designation for the document on your computer or upload the file from an external storage location, e.g. a USB stick.
Who has access to my identity if I disclose it?
Access to your identity in the application is restricted to the ombusperson. It may be disclosed to the persons authorized by the organization to process your report or question, if you have consented in the ombudsperson's forwarding it along with the report to the Legal/Compliance department of the organization.
The organization is required to ensure that your identity is not disclosed to anyone beyond the authorized persons competent to receive or follow up on reports, without your explicit consent. This also applies to any other information from which your identity may be directly or indirectly deduced.
Your identity and any other information referred to in the preceding paragraph may be disclosed only where this is a necessary and proportionate obligation imposed by law in the context of investigations by national authorities or judicial proceedings, including with a view to safeguarding the rights of defense of the person concerned.
Can you track me through the IP address?
No.
Trusty AG cannot track you through your IP address. In order to ensure your confidentiality and anonymity, the application websites do not store IP addresses and time stamps.
To protect your identity, you should avoid submitting your report and accessing your inbox in the application using the organization’s network.
Who will process my report?
Your report will be processed by the ombudsperson and – with your consent – the ombudsperson’s contact person working in the Legal/Compliance department of the organization, according to the organization’s own procedures for internal reporting and follow-up.
Trusty AG is the provider of the application and will not process your report, nor access its content.
In what time can I expect to receive feedback from the organization?
According to the EU Whistleblower Protection Directive the receipt of your report should be confirmed within a week. Feedback with regard to the content of your report should be provided no later than in 3 months.
The feedback is required to inform you of the action envisaged or taken as follow-up and of the grounds for such follow-up to the extent that is legally permitted. However, the EU Whistleblower Protection Directive does not define any time limit within which the follow-up actions need to have been completed by the organization. Refer to the organization’s policies for any specifics or ask the ombudsperson.
Can I follow the processing of my report or question?
Yes.
You can follow the process by clicking on "Your inbox". The link will direct you to the inbox log in page where you will need to enter the username and password that you will receive after submitting the report or question.
The inbox allows you to follow the processing of your report or question, communicate securely with the organization and receive its feedback on your report or question.
Can I use the inbox if I remain anonymous?
Yes.
After submitting your report or question you are assigned a username and a password to access the inbox, regardless of whether you disclose your identity or not. Please make sure that you note your username and password as they cannot be restored and are not saved for security reasons.
I was warned of retaliation. What is this all about?
Retaliation means any direct or indirect act or omission which occurs in a work-related context and which usually causes or may cause unjustified detriment to you and is imposed on you as a result of your report.
How am I protected against retaliation?
Whistleblowers reporting in good faith enjoy protection against retaliation. Retaliation is strictly forbidden by the organization and is a compliance misconduct itself. Please refer to the organization’s policies and respective national laws for details or ask the ombudsperson.
